This Acceptable Use Policy ("AUP") is part of the Terms of Service for the Vinea service (the "Service") and applies to everyone who uses it. It exists because Vinea sends outreach email and gathers data from third-party sources — activities that are tightly regulated. Violating this AUP is a material breach and may result in suspension or termination.
1. Email and outreach
You are solely responsible for the messages you send and the recipients you select. You must:
1.1 Send only lawful, business-relevant outreach. Comply with all applicable electronic-marketing and anti-spam laws, including, as relevant to your recipients:
- EU/EEA — GDPR and the ePrivacy rules (valid lawful basis; for B2B prospecting, a documented legitimate-interests assessment);
- United States — CAN-SPAM (accurate headers and sender identity, valid physical postal address, working opt-out honoured promptly);
- Canada — CASL (generally requires consent; significant penalties);
- any other applicable local law.
1.2 Honour opt-outs and objections. Provide a working unsubscribe/opt-out, suppress anyone who objects, and do not contact suppressed recipients again.
1.3 Be truthful. No false or misleading sender identity, subject lines, headers, or claims. Disclose your identity and the commercial nature of the message where required.
1.4 Send only to legitimately obtained business contacts. Do not upload or target purchased spam lists, scraped consumer addresses, or recipients you have no lawful basis to contact.
1.5 Respect volume and reputation limits. Do not use the Service to send unsolicited bulk mail ("spam"), or in a way that harms the deliverability or reputation of shared sending infrastructure.
2. Data and third-party sources
2.1 Use Discovered Data only for legitimate B2B outreach and only where you have a lawful basis. 2.2 Do not instruct the Service to target sources you are prohibited from accessing, to bypass access controls or paywalls, or to collect special-category personal data or consumer (non-business) personal data. 2.3 Do not re-sell, redistribute, or build a competing dataset/product from Discovered Data.
3. Prohibited content and conduct
You must not use the Service to:
- send unlawful, fraudulent, deceptive, harassing, defamatory, hateful, or sexually explicit content;
- impersonate any person or organisation, or misrepresent your affiliation;
- distribute malware, phishing, or links to malicious content;
- infringe intellectual-property or privacy rights;
- violate sanctions/export-control laws or contact sanctioned parties;
- probe, scan, overload, or attempt to breach the Service or its infrastructure;
- use the Service to generate or send content that violates an AI provider's usage policies.
4. AI-generated content
You must review AI-generated drafts before sending and are responsible for their accuracy, legality, and tone. Do not present AI output as independent professional advice.
5. Enforcement
We may investigate suspected violations and may suspend or terminate access, remove content, and report unlawful activity to authorities. We may act immediately where there is risk of legal liability, security harm, or damage to sending reputation.
